Uncivil, Illegal and Unlawful 1989 Order of KPS Gill

This article is for the Doubting Thomasses. This is just one sample of the many pieces of evidence which were presented to Indian courts one after another only to be either set aside or simply ignored. Someday, when Sikhs are able to set their own Nuremberg type trials, KPS Gill will be tried, even if posthumously.

If anyone has any doubts about the barbaric, illegal and unlawful nature of work done by KPS Gill, read this. Delhi-based human rights lawyer Tejinder Singh, in an affidavit which the Punjab police filed in a case of involuntary disappearance, accidentally stumbled upon this 1989 order of KPS Gill which enlists 53 insurgents, whom the police called terrorists and which directs the district police chiefs to kill them for a prize money mentioned against their names.

Shocked at the written order asking the district police chiefs to kill them for prize money without following any due process, the order was challenged in the High Court of Punjab and Haryana. Cornered, the government of Punjab, after dilly dallying in the courts submitted another document in which the order was liquidation was removed but the list was maintained.

Significantly, after a couple of hearings, the Punjab and Haryana High Court accepted the submission of the police and the State of Punjab without any punitive remarks or judgement against the police chief.

The struggling Sikh youth took it in their stride. They were not particularly shocked because this has happened with the Sikhs in history. The Mughal rulers, like the present rulers too had fixed a price for Sikh heads and the Mughal army would kill Sikhs and take money from their chieftains.

In its report entitled, Punjab Police: Beyond the Bounds of the law published in May 1995, internationally renowned human rights body, Amnesty International says, “Amnesty International is concerned at a pattern of human rights violations committed by officers of the Punjab police acting outside their home state. There have been a series of incidents in recent years in which Punjab police have transgressed their operational jurisdiction, travelling, often in vehicles without number plates, to other Indian states to carry out under-cover operations which resulted in serious human rights violations. These included abducting wanted Sikh suspects who have subsequently “disappeared” or been killed in custody.

Reports indicate that the Punjab police have been conducting such operations in states other than Punjab without seeking permission of the authorities of the states concerned or giving them prior information about their actions. This is illegal according to the Constitution of India: the responsibility for the maintenance of public order within the territory of a state and for the police rests exclusively with the state government concerned. As far as Amnesty International is aware, little progress has been made in investigations ordered into these allegations and in the majority of the cases those responsible have not been brought to justice.”

As reported by Amnesty International, when asked to comment on allegations of involuntary disappearances in London, KPS Gill said, “that allegations of “disappearances” were entirely unfounded since they concerned young men who had left the country and were living abroad.” Who does not know that hundreds had to flee the country to save their own lives and that of their families as they were being hounded by KPS Gill and his men.
